GENERAL TERMS AND CONDITIONS OF HIPPE GIRLS B.V.

Article 1 - Definitions
For the purposes of these general terms and conditions, the following definitions apply:
- Cooling-off period: the time frame during which the consumer may exercise the right of withdrawal.
- Consumer: a natural person who is not acting for purposes related to his or her trade, business, craft, or profession.
- Day: calendar day.
- Long-term transaction: a distance contract covering a series of products and/or services for which the obligation to deliver and/or purchase is spread out over time.
- Durable medium: any medium that enables the consumer or Hippe Girls to store information addressed personally to him or her in a way that allows for future reference and unaltered reproduction.
- Right of withdrawal: the consumer’s legal right to cancel a distance contract within the cooling-off period without providing a reason.
- Model Withdrawal Form: the form that consumers can use to notify Hippe Girls that they wish to exercise their right of withdrawal.
- Hippe Girls / Business entity: Hippe Girls B.V., as described in Article 2.
- Agreement: any agreement entered into between Hippe Girls and the consumer.
- Distance contract: a contract concluded between Hippe Girls and the consumer within the framework of an organized distance selling system, in which one or more means of distance communication are used exclusively or in part up to and including the conclusion of the contract.
- Website: the website Hippe Girls and the online store offered on it.

Article 3 - Applicability
- These terms and conditions apply to every offer made by Hippe Girls and to every distance contract between Hippe Girls and the consumer.
- Before the contract is concluded, these general terms and conditions will be made available in such a way that the consumer can easily access and save them.
- If the agreement is entered into electronically, these general terms and conditions may be made available to the consumer electronically.
- If, in addition to these general terms and conditions, specific product, promotional, shipping, or return terms apply, these will also be clearly disclosed to the consumer.
- Additional terms and conditions may not deviate from mandatory consumer protection laws in a manner that is detrimental to the consumer.
- If any provision of these general terms and conditions is found to be wholly or partially void or voidable, the remaining provisions shall remain in effect. The provision in question shall then, to the extent possible, be replaced by a valid provision that corresponds as closely as possible to the purpose and intent of the original provision.
Article 4 - The Offer
- If an offer has a limited validity period or is subject to specific conditions, this will be clearly stated in the offer.
- The offer contains a description of the products and/or services offered that is as complete and accurate as possible.
- The description is detailed enough to enable consumers to make a sound assessment of the offer.
- Images are displayed as accurately as possible. Due to monitor settings, colors may differ slightly from the actual product.
- Obvious errors, typos, and clear pricing or entry errors are not binding on Hippe Girls if it is clear to the consumer—or should reasonably have been clear to the consumer—that an error had occurred.
- As part of the offer, clear information must be provided prior to the conclusion of the agreement regarding, among other things:
- the price, including applicable taxes;
- any shipping costs;
- the product's key features;
- the available payment and shipping methods;
- the expected delivery time;
- the existence of the right of withdrawal or, if applicable, a statutory exception to it;
- the procedure for exercising the right of withdrawal;
- any special terms and conditions that apply to the product or the offer.
Article 5 - The Agreement
- The agreement is concluded at the moment the consumer accepts the offer from Hippe Girls and meets the conditions set forth therein.
- When a consumer places an order electronically, Hippe Girls confirms receipt of the order electronically.
- Hippe Girls takes appropriate technical and organizational measures to secure the electronic transmission of data and ensures that the payment environment is adequately secured.
- Hippe Girls may, within the limits of the law, refuse an order or impose additional conditions if there is a valid reason to do so, such as in cases of suspected fraud or abuse, or if payment cannot be authorized.
- If an ordered product unexpectedly turns out to be unavailable, the consumer will be notified as soon as possible. Any amounts already paid for a product that cannot be delivered will be refunded if no suitable solution is agreed upon with the consumer.
Article 6 - Right of Withdrawal and Cooling-Off Period
- When purchasing products through the online store, the consumer has the legal right to cancel the contract within 14 days without providing a reason.
- The cooling-off period begins on the day after the consumer—or a third party designated in advance by the consumer who is not the carrier—has received the product.
- If an order consists of multiple products that are delivered separately, the cooling-off period begins on the day after the last product is received.
- The consumer may exercise the right of withdrawal within the cooling-off period by unambiguously notifying Hippe Girls of this decision. This can be done, for example, using the model withdrawal form, by email, or through another clear statement.
- Once the consumer has notified the seller of their intention to exercise the right of withdrawal, the product must be returned within 14 days at the latest.
- The consumer should handle the product and its packaging with care.
- The consumer may only unpack, inspect, or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product, just as would be possible in a physical store.
- If the consumer uses the product beyond what is necessary to evaluate it, the consumer is liable for any resulting loss in value, unless Hippe Girls failed to provide all legally required information regarding the right of withdrawal before or at the time the contract was concluded.
- If the product is damaged or the packaging is damaged beyond what is necessary to inspect the product, Hippe Girls may charge the consumer for the resulting loss in value. Therefore, please handle the product with care and ensure that it is properly packaged when returning it.
- The product must, if reasonably possible, be returned with all accessories provided and in its original condition and packaging.
- The consumer should keep proof of shipment so that, if necessary, it can be shown that the return was sent on time.
- In addition to the 14-day statutory cooling-off period, Hippe Girls offers an extended return option valid for up to 30 days after receipt. The terms and conditions set forth in the return policy on the website apply to this extended return option. This extended return option does not limit the consumer’s statutory rights.

Article 7 - Costs and Refunds in the Event of Cancellation
- The direct costs of returning a product are the responsibility of the consumer, unless Hippe Girls has indicated that it will cover these costs or if the product is defective or was delivered incorrectly.
- Hippe Girls informs the consumer before the purchase that the costs of a standard return shipment are the consumer's responsibility.
- If the consumer cancels the entire order within the statutory cooling-off period, Hippe Girls will refund the full purchase price, including the cost of the least expensive standard shipping option offered by Hippe Girls.
- If the consumer chose a more expensive shipping method than the cheapest standard shipping option when placing the original order, Hippe Girls is not required to refund the additional costs.
- If only part of an order is returned, the original shipping costs will not be refunded.
- If the original order qualified for free shipping due to a minimum order amount, and the value of the retained items falls below that threshold as a result of a partial return, the shipping discount previously granted may be revoked. The standard shipping fee may then be deducted from the refund amount, provided that this condition has been clearly communicated to the consumer in advance.
- Hippe Girls pay the amount due as soon as possible and no later than 14 days after the consumer has notified the merchant of the cancellation.
- Hippe Girls may wait to issue a refund until the returned product has been received or until the consumer has provided proof that the product has been returned, whichever occurs first.
- Refunds will be issued using the same payment method the consumer used for the original payment, unless the consumer expressly agrees to a different payment method. No additional fees will be charged for the refund.
Article 8 - Exclusion of the Right of Withdrawal
- The right of withdrawal may be excluded only for products and services for which the law permits such an exclusion and when the consumer has been clearly informed of this prior to the conclusion of the contract.
- Exclusions may apply to, among other things:
a. products manufactured according to the consumer’s specifications and that are not prefabricated;
b. products that are clearly of a personal nature or have been specially personalized for the consumer;
c. products that spoil quickly or have a limited shelf life;
d. Sealed products that, for health or hygiene reasons, are not suitable for return and whose seal has been broken after delivery.
- For Blomdahl earrings that are delivered in special, sealed hygienic packaging, the exception specified in paragraph 2(d) applies.
- These Blomdahl earrings are packaged under controlled conditions in a cleanroom and delivered in sealed, hygienic packaging.
- As long as the seal is intact, these Blomdahl earrings may be returned in accordance with the applicable return policy.
- Once the seal has been broken after delivery or the sealed hygienic packaging in question has been opened, the right of withdrawal is forfeited for reasons of health protection and hygiene, provided that this exception is clearly stated on the product prior to purchase.
- If Blomdahl earrings with a broken seal are returned anyway, Hippe Girls cannot accept the return. If the customer wishes to have the items returned, the cost of reshipping may be charged to the customer.
Article 9 - Prices
- All prices shown to consumers include sales tax, unless otherwise specified.
- Any shipping or other additional costs will be clearly displayed before the order is finalized.
- The price in effect at the time the contract is concluded is the agreed-upon price.
- Obvious errors in price, printing, or data entry are not binding on Hippe Girls if it is clear to the consumer—or should reasonably be clear to the consumer—that a mistake has been made.
- Price changes that occur after an agreement has been concluded do not affect that agreement, except for changes that result directly from statutory provisions and to the extent that such changes may be passed on in accordance with the law.
Article 10 - Conformity and Statutory Warranty
- Hippe Girls guarantees that the products delivered comply with the agreement, the specifications stated in the offer, and the requirements that the consumer may reasonably expect the product to meet under the law.
- Consumers are always entitled to the statutory warranty. The duration of the warranty depends on what the consumer can reasonably expect from the product in question, its price, its characteristics, and its normal use.
- A commercial, seller's, or manufacturer's warranty does not affect the consumer's statutory rights.
- If a product does not conform to the agreement, the consumer must report this to Hippe Girls within a reasonable time after discovery. A report made within two months of discovering the defect is, in any case, considered timely.
- If a defect is covered by the statutory warranty, Hippe Girls will provide an appropriate legal remedy, such as repair or replacement, free of charge and within a reasonable time.
- The consumer will not be charged for any necessary shipping, materials, or work covered by the statutory warranty.
- If repair or replacement is not possible, is not carried out within a reasonable time, or cannot be carried out without causing significant inconvenience to the consumer, the consumer may—provided the legal conditions are met—be entitled to a price reduction or termination of the contract.
- The statutory warranty does not apply if the problem can be shown to be the result of, for example:
- incorrect or improper use;
- damage caused by the consumer;
- normal wear and tear;
- inadequate maintenance;
- repairs or modifications made by the consumer or a third party that caused the defect.
- Hippe Girls As the seller, you remain responsible for handling the statutory warranty. Any manufacturer’s warranty is in addition to that.
Article 11 - Delivery and Performance
- Hippe Girls handles orders with the utmost care.
- The place of delivery is the shipping address provided by the consumer when placing the order.
- The consumer is responsible for verifying that the specified shipping address is complete and correct.
- Hippe Girls will deliver within the delivery period agreed upon with the consumer. If no delivery period has been agreed upon, delivery will be made within 30 days at the latest, unless a longer period has been agreed upon.
- If an agreed-upon delivery deadline is not met, the consumer may grant Hippe Girls a reasonable extension to make the delivery.
- An additional period is not always necessary, for example, when a fixed delivery date was agreed upon in advance and timely delivery was essential, or when Hippe Girls indicates that it cannot or will not deliver.
- If Hippe Girls fails to deliver even within an applicable extension of time, the consumer may terminate the contract in accordance with the law.
- Amounts that must be refunded following a valid termination will be refunded as soon as possible.
- Hippe Girls retains the risk of damage to or loss of the product until the product has been delivered to the consumer or to a third party designated by the consumer, unless otherwise required by mandatory law.
- If a package cannot be delivered due to incorrect or incomplete address information provided by the consumer and is therefore returned, any reasonable costs actually incurred for reshipping or returning the package may be charged to the consumer, to the extent permitted by law.
- The same may apply when a package is made available at a pickup location following a delivery attempt, is not picked up within the specified time frame, and is therefore returned to Hippe Girls.
- When a consumer validly exercises the right of withdrawal in such a situation, the legal rules regarding withdrawal and refunds continue to apply.
Article 12 - Term Transactions
- A contract for an indefinite term may be terminated by the consumer subject to the legally required notice period.
- A fixed-term contract may be terminated in accordance with the applicable legal provisions and the terms and conditions communicated prior to the conclusion of the contract.
- Hippe Girls will not tacitly renew a subscription in a manner that violates mandatory consumer protection laws.
- If Hippe Girls does not offer subscriptions or recurring transactions, this article has no practical application to regular one-time orders in the online store.
Article 13 - Payment
- The available payment methods are displayed during checkout.
- The consumer is required to pay the amounts due for the order in accordance with the terms and conditions of the selected payment method.
- Consumers are required to report any errors in payment information provided or displayed to Hippe Girls as soon as possible.
- If payment is made through an external payment service provider, the terms and conditions of that payment service provider may also apply.
- If a consumer fails to pay a due amount on time, Hippe Girls may—after the applicable legal requirements for a demand notice have been met—charge statutory interest and extrajudicial collection costs to the extent permitted by law.
Article 14 - Complaints Procedure
- Hippe Girls has a complaints procedure in place and handles complaints carefully and within a reasonable time frame.
- A complaint can be filed at info@hippegirls.nl.
- Consumers are asked to describe their complaint in as much detail as possible and, if available, to include the order number and any relevant photos or other information.
- A complaint regarding a defect in a product must be reported within a reasonable period of time after it is discovered. A report submitted within two months of discovery is, in any case, considered timely.
- As a general rule, complaints are responded to within 14 days of receipt. If more time is needed to investigate the matter, the consumer will receive a confirmation of receipt and an estimate of the time required to resolve the issue within that period.
- Hippe Girls is a member of WebwinkelKeur.
- If a complaint cannot be resolved through mutual agreement, the consumer may submit the dispute to WebwinkelKeur for mediation.
- If mediation by WebwinkelKeur also fails to resolve the dispute and the applicable conditions are met, the dispute may be submitted to the independent dispute resolution board DigiDispuut. The procedures and conditions of WebwinkelKeur and DigiDispuut apply in such cases.
- A complaint does not automatically suspend payment obligations, unless required by law or unless Hippe Girls confirms otherwise in writing.
Article 15 - Disputes and Governing Law
- Agreements between Hippe Girls and the consumer are governed by Dutch law.
- If the consumer has his or her habitual residence in another country in which Hippe Girls conducts business, this choice of Dutch law may not deprive the consumer of the protection afforded by mandatory consumer protection provisions that would apply to him or her in the absence of this choice of law.
- The parties will make every effort to resolve any dispute through mutual consultation first.
- Consumers may, where applicable, make use of the dispute mediation services offered by WebwinkelKeur and DigiDispuut, as described in Article 14.
- Unless a valid alternative dispute resolution procedure is used, a dispute may be brought before the competent court in accordance with applicable law.
Article 16 - Additional or Different Provisions
- Any additional provisions or provisions that deviate from these general terms and conditions may not, to the detriment of the consumer, deviate from the rights to which the consumer is entitled under mandatory law.
- Additional agreements shall be recorded in writing or on another durable medium when required by law or when reasonably important to the consumer.
- If a separate returns, shipping, privacy, or cancellation policy applies, it shall supplement these general terms and conditions. In the event of any conflict, statutory consumer rights may never be limited by such supplementary provisions.
